Privacy Policy
We are very pleased that you are interested in our company. Data protection is of particularly high priority for the management of Gitarrenschule Wurtinger. It is generally possible to use the Gitarrenschule Wurtinger website without providing any personal data. However, if a data subject wishes to use special services offered by our company via our website, it may become necessary to process personal data. If the processing of personal data is necessary and there is no legal basis for such processing, we generally obtain the consent of the data subject.
The processing of personal data, such as the name, address, email address, or telephone number of a data subject, is always carried out in accordance with the General Data Protection Regulation (GDPR) and in compliance with the country-specific data protection regulations applicable to Gitarrenschule Wurtinger. Through this privacy policy, our company would like to inform the public about the nature, scope, and purpose of the personal data we collect, use, and process. Furthermore, data subjects are informed of the rights to which they are entitled by means of this privacy policy.
Gitarrenschule Wurtinger, as the data controller, has implemented numerous technical and organizational measures to ensure the most complete protection possible of personal data processed via this website. Nevertheless, internet-based data transmissions may in principle have security gaps, so absolute protection cannot be guaranteed. For this reason, every data subject is free to transmit personal data to us by alternative means, e.g., by telephone.
1. Definitions
The privacy policy of Gitarrenschule Wurtinger is based on the terminology used by the European legislator in the adoption of the GDPR. Our privacy policy should be easy to read and understand for the general public as well as for our customers and business partners. To ensure this, we would like to first explain the terminology used.
a) Personal data Personal data means any information relating to an identified or identifiable natural person (“data subject”). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier, or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that natural person.
b) Data subject Data subject means any identified or identifiable natural person whose personal data is processed by the controller responsible for the processing.
c) Processing Processing means any operation or set of operations performed on personal data, whether or not by automated means, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure, or destruction.
d) Restriction of processing Restriction of processing means the marking of stored personal data with the aim of limiting their processing in the future.
e) Profiling Profiling means any form of automated processing of personal data consisting of using personal data to evaluate certain personal aspects relating to a natural person, in particular to analyze or predict aspects concerning that natural person’s performance at work, economic situation, health, personal preferences, interests, reliability, behavior, location, or movements.
f) Pseudonymization Pseudonymization means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organizational measures to ensure that the personal data are not attributed to an identified or identifiable natural person.
g) Controller Controller means the natural or legal person, public authority, agency, or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law.
h) Processor Processor means a natural or legal person, public authority, agency, or other body which processes personal data on behalf of the controller.

However, public authorities which may receive personal data in the framework of a particular inquiry in accordance with Union or Member State law shall not be regarded as recipients.
j) Third party Third party means a natural or legal person, public authority, agency, or body other than the data subject, controller, processor, and persons who, under the direct authority of the controller or processor, are authorized to process personal data.
k) Consent Consent means any freely given, specific, informed, and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.
2. Name and address of the controller
Controller within the meaning of the GDPR, other data protection laws applicable in the member states of the European Union, and other provisions related to data protection law is:
Gitarrenschule Wurtinger Münchener Straße 35 91154 Roth, Germany
Phone: +49 9171 8356161 Email: dino.wurtinger@gmail.com Website: http://www.wurtinger.com
3. Cookies
The Gitarrenschule Wurtinger website uses cookies. Cookies are text files that are stored on a computer system via an internet browser.
Many websites and servers use cookies. Many cookies contain a so-called cookie ID, a unique identifier consisting of a string of characters through which websites and servers can be assigned to the specific internet browser in which the cookie was stored. This enables visited websites and servers to distinguish the individual browser of the data subject from other internet browsers that contain other cookies. A specific internet browser can be recognized and identified using the unique cookie ID.
Through the use of cookies, Gitarrenschule Wurtinger can provide users of this website with more user-friendly services that would not be possible without the cookie setting.
By means of a cookie, the information and offers on our website can be optimized for the benefit of the user. Cookies allow us, as previously mentioned, to recognize users of our website. The purpose of this recognition is to make it easier for users to use our website. A website user who uses cookies does not have to re-enter their access data each time they visit the website, because this is handled by the website and the cookie stored on the user’s computer system. Another example is the cookie of a shopping cart in an online shop. The online shop remembers the items a customer has placed in the virtual shopping cart via a cookie.
The data subject can prevent the setting of cookies through our website at any time by means of a corresponding setting in the internet browser used, and can thus permanently object to the setting of cookies. Furthermore, cookies already set can be deleted at any time via an internet browser or other software programs. This is possible in all common internet browsers. If the data subject deactivates the setting of cookies in the internet browser used, not all functions of our website may be fully usable.
4. Collection of general data and information
The Gitarrenschule Wurtinger website collects a series of general data and information each time the website is accessed by a data subject or an automated system. This general data and information is stored in the server’s log files. The following may be recorded: (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which an accessing system accesses our website (so-called referrers), (4) the sub-websites accessed via an accessing system on our website, (5) the date and time of access to the website, (6) an internet protocol address (IP address), (7) the internet service provider of the accessing system, and (8) other similar data and information used to prevent danger in the event of attacks on our IT systems.
When using this general data and information, Gitarrenschule Wurtinger does not draw any conclusions about the data subject. Rather, this information is required to (1) correctly deliver the content of our website, (2) optimize the content of our website and its advertising, (3) ensure the long-term viability of our IT systems and website technology, and (4) provide law enforcement authorities with the information necessary for prosecution in the event of a cyberattack. This anonymously collected data and information is therefore evaluated statistically by Gitarrenschule Wurtinger, with the aim of increasing data protection and data security within our company, in order to ultimately ensure an optimal level of protection for the personal data we process. The anonymous data in the server log files is stored separately from all personal data provided by a data subject.
5. Routine erasure and blocking of personal data
The controller processes and stores personal data of the data subject only for the period necessary to achieve the purpose of storage, or as provided by European directives and regulations or any other law to which the controller is subject.
If the storage purpose ceases to apply, or if a storage period prescribed by European directives and regulations or another competent legislator expires, the personal data is routinely blocked or erased in accordance with legal requirements.
6. Rights of the data subject
a) Right of confirmation Every data subject has the right to obtain from the controller confirmation as to whether personal data concerning them is being processed. If a data subject wishes to exercise this right of confirmation, they may contact an employee of the controller at any time.
b) Right of access Every person affected by the processing of personal data has the right to obtain from the controller free information about their personal data stored at any time, as well as a copy of this information. Furthermore, the data subject has the right to information about the following:
- the purposes of the processing
- the categories of personal data being processed
- the recipients or categories of recipients to whom the personal data have been or will be disclosed, in particular recipients in third countries or international organizations
- where possible, the envisaged period for which the personal data will be stored, or, if not possible, the criteria used to determine that period
- the existence of a right to rectification or erasure of personal data, or restriction of processing, or a right to object to such processing
- the existence of a right to lodge a complaint with a supervisory authority
- where the personal data is not collected from the data subject, any available information as to their source
- the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) GDPR, and, at least in those cases, meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for the data subject
Furthermore, the data subject has the right to information about whether personal data has been transferred to a third country or an international organization. If this is the case, the data subject also has the right to obtain information about the appropriate safeguards relating to the transfer.
If a data subject wishes to exercise this right of access, they may contact an employee of the controller at any time.
c) Right to rectification Every person affected by the processing of personal data has the right to demand the immediate correction of inaccurate personal data concerning them. Furthermore, the data subject has the right to demand the completion of incomplete personal data, taking into account the purposes of the processing, including by means of a supplementary statement.
If a data subject wishes to exercise this right to rectification, they may contact an employee of the controller at any time.
d) Right to erasure (right to be forgotten) Every person affected by the processing of personal data has the right to obtain from the controller the immediate erasure of personal data concerning them, provided one of the following reasons applies and processing is not necessary:
- The personal data was collected or otherwise processed for purposes for which they are no longer necessary.
- The data subject withdraws their consent on which the processing was based, and there is no other legal basis for the processing.
- The data subject objects to the processing, and there are no overriding legitimate grounds for the processing, or the data subject objects to the processing pursuant to Art. 21(2) GDPR.
- The personal data has been processed unlawfully.
- The erasure of the personal data is necessary to comply with a legal obligation under Union or Member State law to which the controller is subject.
- The personal data was collected in relation to information society services offered pursuant to Art. 8(1) GDPR.
If one of the above reasons applies and a data subject wishes to have personal data stored by Gitarrenschule Wurtinger deleted, they may contact an employee of the controller at any time. The employee of Gitarrenschule Wurtinger will arrange for the erasure request to be complied with immediately.
Where Gitarrenschule Wurtinger has made personal data public and is obliged to erase the personal data pursuant to Art. 17(1) GDPR, our company shall take reasonable measures, including technical measures, taking into account available technology and the cost of implementation, to inform other controllers processing the published personal data that the data subject has requested erasure of any links to, or copies or replications of, that personal data, insofar as processing is not required. The employee of Gitarrenschule Wurtinger will arrange the necessary steps in individual cases.
e) Right to restriction of processing Every person affected by the processing of personal data has the right to obtain from the controller a restriction of processing where one of the following applies:
- The accuracy of the personal data is contested by the data subject, for a period enabling the controller to verify the accuracy of the personal data.
- The processing is unlawful, and the data subject opposes the erasure of the personal data and requests the restriction of their use instead.
- The controller no longer needs the personal data for the purposes of processing, but the data subject requires them for the establishment, exercise, or defense of legal claims.
- The data subject has objected to processing pursuant to Art. 21(1) GDPR, pending verification as to whether the legitimate grounds of the controller override those of the data subject.
If one of the above conditions is met and a data subject wishes to request the restriction of personal data stored by Gitarrenschule Wurtinger, they may contact an employee of the controller at any time. The employee of Gitarrenschule Wurtinger will arrange for the restriction of processing.
f) Right to data portability Every person affected by the processing of personal data has the right to receive personal data concerning them, which they have provided to a controller, in a structured, commonly used, and machine-readable format. They also have the right to transmit that data to another controller without hindrance from the controller to which the personal data was provided, provided that the processing is based on consent pursuant to Art. 6(1)(a) or Art. 9(2)(a) GDPR, or on a contract pursuant to Art. 6(1)(b) GDPR, and the processing is carried out by automated means, provided that the processing is not necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
Furthermore, in exercising their right to data portability pursuant to Art. 20(1) GDPR, the data subject has the right to have personal data transmitted directly from one controller to another, where technically feasible and provided that this does not adversely affect the rights and freedoms of others.
To assert the right to data portability, the data subject may contact an employee of Gitarrenschule Wurtinger at any time.
g) Right to object Every person affected by the processing of personal data has the right, on grounds relating to their particular situation, to object at any time to the processing of personal data concerning them which is based on Art. 6(1)(e) or (f) GDPR. This also applies to profiling based on these provisions.
Gitarrenschule Wurtinger will no longer process personal data in the event of an objection unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights, and freedoms of the data subject, or the processing serves the establishment, exercise, or defense of legal claims.
Where Gitarrenschule Wurtinger processes personal data for direct marketing purposes, the data subject has the right to object at any time to the processing of personal data for such marketing. This also applies to profiling to the extent that it is related to such direct marketing. If the data subject objects to Gitarrenschule Wurtinger’s processing for direct marketing purposes, Gitarrenschule Wurtinger will no longer process the personal data for these purposes.
In addition, the data subject has the right, on grounds relating to their particular situation, to object to the processing of personal data concerning them by Gitarrenschule Wurtinger for scientific or historical research purposes, or for statistical purposes pursuant to Art. 89(1) GDPR, unless such processing is necessary for the performance of a task carried out for reasons of public interest.
To exercise the right to object, the data subject may contact any employee of Gitarrenschule Wurtinger directly. The data subject is also free, in the context of the use of information society services, and notwithstanding Directive 2002/58/EC, to exercise their right to object by automated means using technical specifications.
h) Automated individual decision-making, including profiling Every person affected by the processing of personal data has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them, provided that the decision (1) is not necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is authorized by Union or Member State law to which the controller is subject and which also lays down suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, or (3) is based on the data subject’s explicit consent.
If the decision (1) is necessary for entering into, or the performance of, a contract between the data subject and the controller, or (2) is based on the data subject’s explicit consent, Gitarrenschule Wurtinger shall implement suitable measures to safeguard the data subject’s rights and freedoms and legitimate interests, at least the right to obtain human intervention on the part of the controller, to express their point of view, and to contest the decision.
If the data subject wishes to exercise rights concerning automated decisions, they may contact an employee of the controller at any time.
i) Right to withdraw data protection consent Every person affected by the processing of personal data has the right to withdraw consent to the processing of personal data at any time.
If the data subject wishes to exercise their right to withdraw consent, they may contact an employee of the controller at any time.
7. Data protection in applications and the application process
The controller collects and processes the personal data of applicants for the purpose of processing the application procedure. The processing may also be carried out electronically. This is particularly the case if an applicant submits corresponding application documents electronically, for example by email or via a web form on the website, to the controller. If the controller concludes an employment contract with an applicant, the submitted data will be stored for the purpose of processing the employment relationship in compliance with legal requirements. If the controller does not conclude an employment contract with the applicant, the application documents will be automatically deleted two months after notification of the rejection decision, unless the erasure is contrary to other legitimate interests of the controller. Other legitimate interest in this sense includes, for example, an obligation to provide evidence in proceedings under the German General Equal Treatment Act (AGG).
8. Data protection provisions regarding the use of Facebook
The controller has integrated components of the Facebook company on this website. Facebook is a social network.
A social network is an internet-based social meeting place, an online community, which usually enables users to communicate with each other and interact in a virtual space. A social network can serve as a platform for the exchange of opinions and experiences, or enable the internet community to provide personal or company-related information. Facebook allows users of the social network to create private profiles, upload photos, and network via friend requests.
The operating company of Facebook is Facebook, Inc., 1 Hacker Way, Menlo Park, CA 94025, USA. The controller responsible for the processing of personal data, if a data subject lives outside the USA or Canada, is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland.
With each call to one of the individual pages of this website operated by the controller, on which a Facebook component (Facebook plug-in) has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective Facebook component to download a representation of the corresponding Facebook component from Facebook. An overview of all Facebook plug-ins can be accessed at https://developers.facebook.com/docs/plugins/. As part of this technical process, Facebook is informed of which specific subpage of our website is visited by the data subject.
If the data subject is logged into Facebook at the same time, Facebook recognizes, with each call to our website by the data subject and for the entire duration of their stay on our website, which specific subpage of our website the data subject visits. This information is collected by the Facebook component and assigned to the respective Facebook account of the data subject. If the data subject clicks on one of the Facebook buttons integrated on our website, e.g., the “Like” button, or submits a comment, Facebook assigns this information to the data subject’s personal Facebook user account and stores this personal data.
Facebook always receives information via the Facebook component that the data subject has visited our website if the data subject is logged into Facebook at the same time as visiting our website; this occurs regardless of whether the data subject clicks on the Facebook component. If such a transmission of information to Facebook is not desired by the data subject, they can prevent this by logging out of their Facebook account before visiting our website.
The data policy published by Facebook, available at https://de-de.facebook.com/about/privacy/, provides information on the collection, processing, and use of personal data by Facebook. It also explains what settings options Facebook offers to protect the privacy of the data subject. In addition, various applications are available that allow the suppression of data transmission to Facebook. Such applications can be used by the data subject to suppress data transmission to Facebook.
9. Data protection provisions regarding the use of Google AdSense
The controller has integrated Google AdSense on this website. Google AdSense is an online service that enables the placement of advertising on third-party websites. Google AdSense is based on an algorithm that selects advertisements displayed on third-party websites to match the content of the respective third-party site. Google AdSense allows interest-based targeting of the internet user, implemented through the generation of individual user profiles.
The operating company of the Google AdSense component is Alphabet Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of the Google AdSense component is the integration of advertisements on our website. Google AdSense sets a cookie on the data subject’s IT system. What cookies are has already been explained above. By setting the cookie, Alphabet Inc. is enabled to analyze the use of our website. With each call to one of the individual pages of this website operated by the controller, on which a Google AdSense component has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective Google AdSense component to transmit data for the purpose of online advertising and commission billing to Alphabet Inc. As part of this technical process, Alphabet Inc. gains knowledge of personal data, such as the IP address of the data subject, which serves Alphabet Inc., among other things, to understand the origin of visitors and clicks and subsequently to enable commission billing.
The data subject can prevent the setting of cookies through our website, as described above, at any time by means of a corresponding setting of the internet browser used, and thus permanently object to the setting of cookies. Such a setting of the internet browser used would also prevent Alphabet Inc. from setting a cookie on the data subject’s IT system. In addition, a cookie already set by Alphabet Inc. can be deleted at any time via the internet browser or other software programs.
Google AdSense also uses so-called tracking pixels. A tracking pixel is a miniature graphic embedded in web pages to enable log file recording and analysis, allowing statistical evaluation. Using the embedded tracking pixel, Alphabet Inc. can determine whether and when a website was opened by a data subject and which links were clicked by the data subject. Tracking pixels are used, among other things, to evaluate the flow of visitors on a website.
Via Google AdSense, personal data and information, including the IP address necessary for recording and billing displayed advertisements, are transmitted to Alphabet Inc. in the United States of America. This personal data is stored and processed in the United States of America. Alphabet Inc. may transfer this personal data collected through the technical process to third parties.
Google AdSense is explained in more detail at this link: https://www.google.de/intl/de/adsense/start/.
10. Data protection provisions regarding the use of Google Analytics (with anonymization function)
The controller has integrated the Google Analytics component (with anonymization function) on this website. Google Analytics is a web analytics service. Web analytics involves the collection, gathering, and evaluation of data about the behavior of website visitors. A web analytics service collects, among other things, data on which website a data subject came from (so-called referrer), which subpages of the website were accessed, or how often and for what duration a subpage was viewed. Web analysis is primarily used to optimize a website and to conduct a cost-benefit analysis of internet advertising.
The operating company of the Google Analytics component is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The controller uses the addition “_gat._anonymizeIp” for web analytics via Google Analytics. By means of this addition, the IP address of the data subject’s internet connection is shortened and anonymized by Google if access to our website originates from a member state of the European Union or another contracting state of the Agreement on the European Economic Area.
The purpose of the Google Analytics component is to analyze the flow of visitors to our website. Google uses the data and information obtained, among other things, to evaluate the use of our website, to compile online reports for us showing activities on our websites, and to provide other services related to the use of our website.
Google Analytics sets a cookie on the data subject’s IT system. What cookies are has already been explained above. By setting the cookie, Google is enabled to analyze the use of our website. With each call to one of the individual pages of this website operated by the controller, on which a Google Analytics component has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective Google Analytics component to transmit data for the purpose of online analysis to Google. As part of this technical process, Google gains knowledge of personal data, such as the IP address of the data subject, which serves Google, among other things, to understand the origin of visitors and clicks and subsequently to enable commission billing.
By means of the cookie, personal information, such as access time, the location from which access was made, and the frequency of visits to our website by the data subject, is stored. With each visit to our websites, this personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America. This personal data is stored by Google in the United States of America. Google may transfer this personal data collected through the technical process to third parties.
The data subject can prevent the setting of cookies through our website, as described above, at any time by means of a corresponding setting of the internet browser used, and thus permanently object to the setting of cookies. Such a setting of the internet browser used would also prevent Google from setting a cookie on the data subject’s IT system. In addition, a cookie already set by Google Analytics can be deleted at any time via the internet browser or other software programs.
Furthermore, the data subject has the option of objecting to and preventing the collection of data generated by Google Analytics relating to the use of this website, as well as the processing of this data by Google. To do this, the data subject must download and install a browser add-on available at https://tools.google.com/dlpage/gaoptout. This browser add-on tells Google Analytics via JavaScript that no data or information about website visits may be transmitted to Google Analytics. The installation of the browser add-on is regarded by Google as an objection. If the data subject’s IT system is later deleted, formatted, or reinstalled, the data subject must reinstall the browser add-on to disable Google Analytics. If the browser add-on is uninstalled or deactivated by the data subject or another person within their sphere of control, it is possible to reinstall or reactivate the browser add-on.
Further information and Google’s applicable data protection provisions can be found at https://www.google.de/intl/de/policies/privacy/ and http://www.google.com/analytics/terms/de.html. Google Analytics is explained in more detail at this link: https://www.google.com/intl/de_de/analytics/.
11. Data protection provisions regarding the use of Google Remarketing
The controller has integrated Google Remarketing services on this website. Google Remarketing is a feature of Google AdWords that enables a company to display advertisements to internet users who have previously visited the company’s website. The integration of Google Remarketing therefore allows a company to create user-related advertising and, as a result, display interest-relevant advertisements to the internet user.
The operating company of Google Remarketing services is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of Google Remarketing is to display interest-relevant advertising. Google Remarketing enables us to display advertisements via the Google advertising network or on other websites, tailored to the individual needs and interests of internet users.
Google Remarketing sets a cookie on the data subject’s IT system. What cookies are has already been explained above. By setting the cookie, Google is enabled to recognize the visitor to our website if they subsequently visit websites that are also members of the Google advertising network. With each visit to a website on which the Google Remarketing service has been integrated, the data subject’s internet browser automatically identifies itself to Google. As part of this technical process, Google gains knowledge of personal data, such as the IP address or the surfing behavior of the user, which Google uses, among other things, to display interest-relevant advertising.
By means of the cookie, personal information, such as the websites visited by the data subject, is stored. With each visit to our websites, personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America.
Furthermore, the data subject has the option of objecting to interest-based advertising by Google. To do this, the data subject must access the link www.google.de/settings/ads from each of the internet browsers they use and make the desired settings there.
Further information and Google’s applicable data protection provisions can be found at https://www.google.de/intl/de/policies/privacy/.
12. Data protection provisions regarding the use of Google+
The controller has integrated the Google+ button as a component on this website. Google+ is a so-called social network. A social network is an internet-based social meeting place, an online community, which usually enables users to communicate with each other and interact in a virtual space. A social network can serve as a platform for the exchange of opinions and experiences, or enable the internet community to provide personal or company-related information. Google+ allows users of the social network to create private profiles, upload photos, and network via friend requests.
The operating company of Google+ is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
With each call to one of the individual pages of this website operated by the controller, on which a Google+ button has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective Google+ button to download a representation of the corresponding Google+ button from Google. As part of this technical process, Google is informed of which specific subpage of our website is visited by the data subject. More detailed information about Google+ can be found at https://developers.google.com/+/.
If the data subject is logged into Google+ at the same time, Google recognizes, with each call to our website by the data subject and for the entire duration of their stay on our website, which specific subpage of our website the data subject visits. This information is collected by the Google+ button and assigned to the respective Google+ account of the data subject.
If the data subject clicks on one of the Google+ buttons integrated on our website and thereby gives a Google+1 recommendation, Google assigns this information to the data subject’s personal Google+ user account and stores this personal data. Google stores the data subject’s Google+1 recommendation and makes it publicly available in accordance with the terms and conditions accepted by the data subject in this regard. A Google+1 recommendation given by the data subject on this website is subsequently stored and processed together with other personal data, such as the name of the Google+1 account used by the data subject and the photo stored therein, in other Google services, e.g., search engine results of the Google search engine, the data subject’s Google account, or elsewhere, e.g., on websites or in connection with advertisements. Google is also able to link the visit to this website with other personal data stored at Google. Google further records this personal information for the purpose of improving or optimizing the various Google services.
Google always receives information via the Google+ button that the data subject has visited our website if the data subject is logged into Google+ at the same time as visiting our website; this occurs regardless of whether the data subject clicks on the Google+ button.
If a transmission of personal data to Google is not desired by the data subject, they can prevent such transmission by logging out of their Google+ account before visiting our website.
Further information and Google’s applicable data protection provisions can be found at https://www.google.de/intl/de/policies/privacy/. Further notes from Google on the Google+1 button can be found at https://developers.google.com/+/web/buttons-policy.
13. Data protection provisions regarding the use of Google AdWords
The controller has integrated Google AdWords on this website. Google AdWords is an internet advertising service that allows advertisers to place ads in both Google search engine results and on the Google advertising network. Google AdWords allows an advertiser to pre-set specific keywords, by means of which an ad in Google’s search engine results is displayed only when the user uses the search engine to retrieve a keyword-relevant search result. In the Google advertising network, the ads are distributed to topic-relevant websites using an automatic algorithm and taking into account the previously set keywords.
The operating company of Google AdWords is Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
The purpose of Google AdWords is to promote our website by displaying interest-relevant advertising on the websites of third-party companies and in the search engine results of the Google search engine, as well as displaying third-party advertising on our website.
If a data subject reaches our website via a Google ad, a so-called conversion cookie is placed on the data subject’s IT system by Google. What cookies are has already been explained above. A conversion cookie loses its validity after thirty days and is not used to identify the data subject. Via the conversion cookie, provided the cookie has not yet expired, it can be tracked whether certain subpages, e.g., the shopping cart of an online shop system, were accessed on our website. Through the conversion cookie, both we and Google can track whether a data subject who reached our website via an AdWords ad generated a sale, i.e., completed or cancelled a purchase.
The data and information collected through the use of the conversion cookie are used by Google to compile visit statistics for our website. We in turn use these visit statistics to determine the total number of users referred to us via AdWords ads, i.e., to determine the success or failure of the respective AdWords ad and to optimize our AdWords ads for the future. Neither our company nor other Google AdWords advertising customers receive information from Google that could identify the data subject.
By means of the conversion cookie, personal information, such as the websites visited by the data subject, is stored. With each visit to our websites, personal data, including the IP address of the internet connection used by the data subject, is transmitted to Google in the United States of America.
Such a setting of the internet browser used would also prevent Google from setting a conversion cookie on the data subject’s IT system. In addition, a cookie already set by Google AdWords can be deleted at any time via the internet browser or other software programs.
14. Data protection provisions regarding the use of Instagram
The controller has integrated components of the Instagram service on this website. Instagram is a service that can be qualified as an audiovisual platform, allowing users to share photos and videos, and also enabling the dissemination of such data on other social networks.
The operating company of Instagram services is Instagram LLC, 1 Hacker Way, Building 14 First Floor, Menlo Park, CA, USA.
With each call to one of the individual pages of this website operated by the controller, on which an Instagram component (Insta button) has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective Instagram component to download a representation of the corresponding Instagram component. As part of this technical process, Instagram is informed of which specific subpage of our website is visited by the data subject.
If the data subject is logged into Instagram at the same time, Instagram recognizes, with each call to our website by the data subject and for the entire duration of their stay on our website, which specific subpage the data subject visits. This information is collected by the Instagram component and assigned to the respective Instagram account of the data subject. If the data subject clicks on one of the Instagram buttons integrated on our website, the data and information transmitted are assigned to the data subject’s personal Instagram user account and stored and processed by Instagram.
Instagram always receives information via the Instagram component that the data subject has visited our website if the data subject is logged into Instagram at the same time as visiting our website; this occurs regardless of whether the data subject clicks on the Instagram component. If such a transmission of information to Instagram is not desired by the data subject, they can prevent this by logging out of their Instagram account before visiting our website.
Further information and Instagram’s applicable data protection provisions can be found at https://help.instagram.com/155833707900388 and https://www.instagram.com/about/legal/privacy/.
15. Data protection provisions regarding the use of Twitter
The controller has integrated components of Twitter on this website. Twitter is a multilingual, publicly accessible microblogging service on which users can publish and disseminate so-called tweets, i.e., short messages limited to 280 characters. These short messages are available to everyone, including people who are not registered on Twitter. Tweets are also displayed to the so-called followers of the respective user. Followers are other Twitter users who follow a user’s tweets. Furthermore, Twitter allows a broad audience to be addressed via hashtags, links, or retweets.
The operating company of Twitter is Twitter, Inc., 1355 Market Street, Suite 900, San Francisco, CA 94103, USA.
With each call to one of the individual pages of this website operated by the controller, on which a Twitter component (Twitter button) has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective Twitter component to download a representation of the corresponding Twitter component. Further information about Twitter buttons can be found at https://about.twitter.com/de/resources/buttons. As part of this technical process, Twitter is informed of which specific subpage of our website is visited by the data subject. The purpose of integrating the Twitter component is to enable our users to redistribute the content of this website, to make this website known in the digital world, and to increase our visitor numbers.
If the data subject is logged into Twitter at the same time, Twitter recognizes, with each call to our website by the data subject and for the entire duration of their stay on our website, which specific subpage of our website the data subject visits. This information is collected by the Twitter component and assigned to the respective Twitter account of the data subject. If the data subject clicks on one of the Twitter buttons integrated on our website, the data and information transmitted are assigned to the data subject’s personal Twitter user account and stored and processed by Twitter.
Twitter always receives information via the Twitter component that the data subject has visited our website if the data subject is logged into Twitter at the same time as visiting our website; this occurs regardless of whether the data subject clicks on the Twitter component. If such a transmission of information to Twitter is not desired by the data subject, they can prevent this by logging out of their Twitter account before visiting our website.
Twitter’s applicable data protection provisions can be found at https://twitter.com/privacy?lang=de.
16. Data protection provisions regarding the use of YouTube
The controller has integrated components of YouTube on this website. YouTube is an internet video portal that allows video publishers to upload video clips free of charge, and other users to view, rate, and comment on them, also free of charge. YouTube allows the publication of all types of videos, which is why complete film and television broadcasts, as well as music videos, trailers, or videos made by users themselves, can be accessed via the internet portal.
The operating company of YouTube is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.
With each call to one of the individual pages of this website operated by the controller, on which a YouTube component (YouTube video) has been integrated, the internet browser on the data subject’s IT system is automatically prompted by the respective YouTube component to download a representation of the corresponding YouTube component. Further information about YouTube can be found at https://www.youtube.com/yt/about/de/. As part of this technical process, YouTube and Google are informed of which specific subpage of our website is visited by the data subject.
If the data subject is logged into YouTube at the same time, YouTube recognizes, when a subpage containing a YouTube video is accessed, which specific subpage of our website the data subject visits. This information is collected by YouTube and Google and assigned to the respective YouTube account of the data subject.
YouTube and Google always receive information via the YouTube component that the data subject has visited our website if the data subject is logged into YouTube at the same time as visiting our website; this occurs regardless of whether the data subject clicks on a YouTube video. If such a transmission of information to YouTube and Google is not desired by the data subject, they can prevent this by logging out of their YouTube account before visiting our website.
The data protection provisions published by YouTube, available at https://www.google.de/intl/de/policies/privacy/, provide information on the collection, processing, and use of personal data by YouTube and Google.
17. Payment method: Data protection provisions regarding PayPal
The controller has integrated PayPal components on this website. PayPal is an online payment service provider. Payments are processed via so-called PayPal accounts, which represent virtual private or business accounts. PayPal also offers the option of processing virtual payments via credit cards if a user does not have a PayPal account. A PayPal account is managed via an email address, so there is no classic account number. PayPal enables online payments to be triggered to third parties or received. PayPal also assumes fiduciary functions and offers buyer protection services.
The European operating company of PayPal is PayPal (Europe) S.à.r.l. & Cie. S.C.A., 22-24 Boulevard Royal, 2449 Luxembourg, Luxembourg.
If the data subject selects “PayPal” as the payment option during the ordering process in our online shop, data is automatically transmitted to PayPal. By selecting this payment option, the data subject consents to the transmission of personal data required for payment processing.
The personal data transmitted to PayPal generally includes first name, last name, address, email address, IP address, phone number, mobile phone number, or other data necessary for payment processing. Personal data related to the respective order is also necessary for the execution of the purchase contract.
The purpose of the data transmission is payment processing and fraud prevention. The controller will transmit personal data to PayPal in particular where there is a legitimate interest in the transmission. The personal data exchanged between PayPal and the controller may be transmitted by PayPal to credit reporting agencies. This transmission is intended for identity and creditworthiness checks.
PayPal may pass on personal data to affiliated companies and service providers or subcontractors, insofar as this is necessary to fulfil contractual obligations or the data is to be processed on their behalf.
The data subject has the option of withdrawing consent for the handling of personal data at any time from PayPal. A withdrawal does not affect personal data that must be processed, used, or transmitted for (contractual) payment processing.
PayPal’s applicable data protection provisions can be found at https://www.paypal.com/de/webapps/mpp/ua/privacy-full.
18. Legal basis for processing
Art. 6(1)(a) GDPR serves as the legal basis for processing operations for which we obtain consent for a specific processing purpose. If the processing of personal data is necessary for the performance of a contract to which the data subject is party, as is the case, for example, with processing operations necessary for the supply of goods or the provision of any other service or consideration, the processing is based on Art. 6(1)(b) GDPR. The same applies to such processing operations that are necessary for carrying out pre-contractual measures, for example in cases of inquiries concerning our products or services. If our company is subject to a legal obligation by which processing of personal data becomes necessary, such as for the fulfilment of tax obligations, the processing is based on Art. 6(1)(c) GDPR. In rare cases, the processing of personal data may become necessary to protect the vital interests of the data subject or another natural person. This would be the case, for example, if a visitor were injured on our premises and their name, age, health insurance data, or other vital information had to be passed on to a doctor, hospital, or other third party. In that case, the processing would be based on Art. 6(1)(d) GDPR. Finally, processing operations could be based on Art. 6(1)(f) GDPR. Processing operations not covered by any of the aforementioned legal grounds are based on this legal basis if the processing is necessary to safeguard a legitimate interest of our company or a third party, provided the interests, fundamental rights, and freedoms of the data subject do not prevail. Such processing operations are permitted to us in particular because they have been specifically mentioned by the European legislator, who took the view that a legitimate interest could be assumed if the data subject is a customer of the controller (Recital 47, Sentence 2 GDPR).
19. Legitimate interests in the processing pursued by the controller or a third party
Where the processing of personal data is based on Art. 6(1)(f) GDPR, our legitimate interest is the conduct of our business activities for the benefit of the wellbeing of all our employees and our shareholders.
20. Duration for which personal data will be stored
The criterion for the duration of the storage of personal data is the respective statutory retention period. After the expiry of this period, the corresponding data is routinely deleted, provided it is no longer required for the fulfilment or initiation of a contract.
21. Statutory or contractual provisions for the provision of personal data; necessity for the conclusion of the contract; obligation of the data subject to provide the personal data; possible consequences of failure to provide such data
We clarify that the provision of personal data is partly required by law (e.g., tax regulations) or can also result from contractual provisions (e.g., information about the contractual partner). It may sometimes be necessary for a data subject to provide us with personal data, which must subsequently be processed by us, in order to conclude a contract. The data subject is, for example, obliged to provide us with personal data when our company concludes a contract with them. Failure to provide the personal data would mean that the contract with the data subject could not be concluded. Before personal data is provided by the data subject, the data subject must contact one of our employees. Our employee will inform the data subject, on a case-by-case basis, whether the provision of personal data is required by law or contract, or is necessary for the conclusion of the contract, whether there is an obligation to provide the personal data, and the consequences of failure to provide it.
22. Existence of automated decision-making
As a responsible company, we do not use automatic decision-making or profiling.
